MODA for iPhone and iPad — the Earned Equity program

The short version
You can look without telling us who you are.
MODA does not ask you to create an account. There is no login, no email address, and no password. While you are exploring, we do not know who you are — we see that someone modelled a purchase on a particular home, on particular terms, and that is all.
If you later sign a lease and an option with Moda Homes, that changes, and this policy explains how.
What this app does
The MODA app lets you model what it would look like to lease a Moda Homes property and hold an option to purchase it. You choose the terms — the price, the rent, the option fee, the rewards rate, the length — and the app shows what would accrue over the term.
Once you save a structure, the app runs a simulation from that day forward, and can notify you when each monthly reward period would complete.
The simulation is illustrative. It is not an offer, and nothing is issued to you unless and until you sign an option agreement with Moda Homes.
While you are exploring
What we receive
When you build a structure, we receive:

Each structure carries its own randomly generated reference so it can be told apart from the others on your device. Those references are not derived from anything about you or your phone, and there is no identifier that ties your structures together or follows you between them.
What we do not receive
- your name
- your email address
- your phone number
- your postal address
- your income, employment, or household information
- your contacts, photos, microphone, or camera
- your precise location
We do not ask you for any of it, and the app has no way to send it.
Why we collect anything at all
Moda builds homes and sets the terms of the programs offered on them. Knowing which communities people are looking at, and which structures they build, is how we decide where to build next and how to price what we offer.
It is also how we make the case to lenders for opening the program in markets where it is not yet available. When several hundred people model purchases on homes in a market we cannot yet write deals in, that is the evidence that supports changing it.
None of that requires knowing who you are, so we do not collect it.
What is stored on your device
Your saved structures, the simulation’s start date, and your scheduled notifications are stored on your phone. If you delete the app they are deleted with it.
Notifications
The app sends two kinds of notification and they work differently. Which you receive depends on whether you are exploring or have become a resident.
While you are exploring
If you allow notifications, your device schedules them itself. We do not send them, we do not hold a device token for you, and nothing about them reaches us.
Your phone works out the dates when you save a set of terms and alerts you from its own clock. Nothing passes through our servers, and we do not know whether a notification was delivered or opened.
Once you have signed with Moda Homes
When you become a resident and your Rental Rewards are delivered to your wallet, we send you a notification to tell you. That is a real event on the record rather than a date on a calendar, so your phone cannot predict it and we have to send it.
To do that we hold a device token for you — an identifier Apple gives us so a message can reach your phone. It does not identify you to anyone else and it is not shared. If you turn notifications off, we stop using it.
These notifications tell you when something has happened to your record. We do not send marketing, offers, or reminders to come back.
This is the difference between exploring and being a resident, and it is deliberate. Before you sign, nothing about you needs to reach us and nothing does. Afterwards you have an account with us, and telling you when your rewards arrive is part of it.
You can turn notifications off at any time in your device settings, in either mode.
The home screen widget
If you add the MODA widget, it reads the on-device data described above so it can show your simulated balance. Nothing leaves your device.
Analytics and diagnostics
We do not use analytics, advertising, or tracking services in this app. We do not collect crash reports or diagnostic data. There is no third-party software development kit in the app that reports to anyone.
While you are exploring, the only information that reaches us is the structures you build, described above. We verified that by monitoring every connection the app makes during a full session — building terms, granting notification permission, and receiving a reward notice — and it made none.
If you sign an agreement with Moda Homes
This is where the anonymity ends, and it happens only if you choose to become a customer.
Your earlier activity becomes part of your customer record. The structures you built while exploring, and the terms you were considering, are joined to your customer file. It shows how you arrived at the terms you chose, and it helps us serve residents better.
If you would rather that history were not carried across, tell us and we will delete it.
You give us a wallet address. Your option record and any Rental Rewards are delivered to a digital wallet you control, and we ask for that wallet’s public address so the record can be sent to it.
This version of the app has no wallet connection built into it. If that changes, we will update this policy before it does — connecting a wallet through third-party software would mean that provider receives technical information about the connection, and you should know that before it happens rather than after.
A wallet address is recorded on a public blockchain. Anyone can see that an option record and rewards went to that address, and the terms recorded with them. That is deliberate: the point of the record is that it can be verified independently by a lender, a title company or a regulator, without relying on anything Moda says.
Your name and contact details are not written to the blockchain. The public record shows an address, not a person.
We hold the keys to nothing. The wallet is yours. Moda cannot move your option record or your rewards, and cannot recover your wallet if you lose access to it.
And we hold a device token for you, so we can tell you when your rewards are delivered. That is described under Notifications above.
Information you give Moda Homes as part of leasing a home — your application, your lease, your payments — is governed by the agreements you sign with us, not by this policy. This policy covers the MODA app.
Who we share it with
We do not sell your information and we do not share it with advertisers.
We use service providers to run the app — hosting and data storage — who process information on our behalf and are not permitted to use it for anything else.
We may share aggregated information that does not identify anyone: how many people modelled purchases in a market, what terms were most common, how interest changed over time. That is what we show lenders and partners, and it does not identify individuals.
Children
MODA is not directed at children and is not intended for anyone under 18. We do not knowingly collect information from children.
Your rights
While you are exploring, there is nothing we hold that identifies you, so there is generally nothing for us to disclose, correct or delete.
If you have signed an agreement with Moda Homes, you can ask what we hold about you and ask us to correct or delete it. Some information we are required to keep by law or under the agreements you have signed.
Depending on where you live, you may have specific rights under laws such as the California Consumer Privacy Act. We will honour them.
Changes to this policy
If we change what we collect, we will update this policy and change the date at the top.
